1. Owner of the website

In compliance with article 10 of Spanish Act 34/2002, on information society services and electronic commerce (LSSI-CE), the details of the owner of holdesk.es are as follows:

APLICACIONES SAAS IBERICA, S.L. is a sole-shareholder company, a status stated here in accordance with article 13.2 of the Spanish Companies Act.

2. Purpose

This legal notice governs access to and use of the website holdesk.es, whose purpose is to present Holdesk, a booking and management system for accommodation businesses, and to let interested parties get in touch or access the service they have contracted.

Browsing this site gives you the status of user and means you accept these terms. If you do not agree with them, do not use the site.

The terms governing the provision of the Holdesk service to accommodation clients are in the terms of service.

3. What this site is and what it is not

This is worth clarifying, because two different things live at holdesk.es:

• The informational website. It explains what Holdesk is and how to contract it. Nothing is sold or contracted from here: contracting is closed over WhatsApp or by email, after a conversation.
• Each property's booking screens. The booking engine, check-in, payment and related pages are served from this domain, but the seller there is the property, not Holdesk. Holdesk is only the technology provider. The terms of the booking, the prices, the cancellation policy and any complaints are the responsibility of the property you are booking with, whose identity is shown on the screen itself.

4. Terms of use

You undertake to use the website in accordance with the law, this legal notice and good faith. In particular, you must not:

• Use the site for unlawful purposes or purposes harmful to third parties.
• Introduce or spread programs capable of damaging the owner's or third parties' systems.
• Attempt to access restricted areas, other people's accounts or internal systems.
• Carry out actions that overload, damage or prevent the normal operation of the service.
• Extract the site's content in bulk by automated means.

5. Intellectual and industrial property

The code, design, texts, trade marks, logos and other content of this site belong to APLICACIONES SAAS IBERICA, S.L. or are used with their owners' permission. Their reproduction, distribution, public communication or transformation without express written authorisation is prohibited, except for uses permitted by law.

The names, logos and images of the properties that appear on the booking screens belong to each property, which supplies them and is answerable for holding the right to use them.

Third-party names and trade marks appearing on the site belong to their respective owners and are cited for information purposes only.

6. Liability

The owner endeavours to keep the published information correct and up to date, but does not warrant that it is free from errors or fit for any particular purpose. References to prices, features or timescales are indicative and may change.

The owner is not liable for service interruptions arising from causes beyond its control, nor for damage that may arise from use of the site, except where the law imposes such liability.

As regards bookings, Holdesk is not answerable for actual availability, price, the condition of the property or performance of the accommodation contract, which are the property's sole responsibility.

7. Links to other sites

This site may contain links to third-party pages. The owner neither controls nor is answerable for their content or their privacy policies. Their inclusion implies no recommendation of, nor any relationship with, those companies.

8. Data protection and cookies

The processing of personal data is explained in the privacy policy, and the use of cookies in the cookie policy.

9. Accessibility

We work to make this site and the booking engine usable with a keyboard, with a screen reader and with sufficient contrast. If you find a barrier that stops you completing a booking or reading a page, write to us at hola@holdesk.es and we will fix it.

10. Applicable law

These terms are governed by Spanish law. For any dispute, the parties submit to the courts and tribunals with jurisdiction under the applicable rules; where the user is a consumer, those of their place of residence.
